ASIC launches inquiry into ASX

The Australian Securities & Investments Commission (ASIC) has launched an inquiry into the Australian Securities Exchange (ASX) group, focusing on governance, capability, and risk management frameworks that have been utilised across the group.

The inquiry follows concerns from ASIC and the Reserve Bank of Australia (RBA) over ASX’s ability to maintain a secure, stable, and resilient market infrastructure.

Concerns began after the CHESS batch settlement failure incident that occurred on 20 December, where the management of operational risk was called into question.

The regulatory body will also assess how well the group has been complying with its obligations as a market licensee and a clearing and settlement facility licensee.

Commenting on the investigation, ASIC Chair Joe Longo, says: “ASX operates Australia’s critical markets infrastructure. Investors and market participants deserve to have absolute confidence that ASX is operating soundly, securely and effectively.

“ASIC’s decision to initiate an Inquiry follows repeated and serious failures at ASX. The Inquiry provides an opportunity for ASX to bolster market trust.”

ASX adds that it will fully cooperate with the inquiry.
